Big win for the building industry.

Late Friday night, we received confirmation from the team at Florida Home Builders Association that Florida House Bill 337 has been signed by Governor Ron DeSantis.

House Bill 337 is the impact fee bill. This bill states impact fees cannot be raised more than 50% in 4 years, and no more than 12.5% a year. This also cleans the language of how impact fee money can be used. To review the bill click here

The building industry believes impact fees are a tax on new construction.

Recently in our community we dealt with the city of Punta Gorda raising impact fees 300% during the pandemic. Charlotte County was wanting to double impact fees. This bill is retroactive to January 2021, so at this time Charlotte County impact fees will remain where they are.

Consult Engineering

Consult Engineering’s new YouTube channel is called Building Integrity. Founder and Principal Engineer, Josh Porter, conceived of the channel as an educational (and entertaining) outreach of our company, as well as a digital brochure for our company, staff and services. While the inspiration was to find an alternative to traditional marketing during the Covid-19 era, the purpose is literally to build integrity within the construction industry through education and accountability. The target audience is the homeowning public, property managers, contractors, tradesmen, students and anyone interested in construction. We launched the channel just before Christmas with a good amount of content for subscribers to digest. Going forward we will build our video library with episodes featuring interviews with industry leaders from our office studio, on-the-job videos shot in the field during our inspections, in depth lessons with Josh at his desk and various fun, informational or visually appealing short videos.

AD&C Loan Volume: Monday, June 7
Continuing a period of weakness that began at the end of 2019, the volume of residential construction lending declined 2.3% during the third quarter of 2020. Home builders were deleveraging during the market rebound of the second half of 2020, as the cost of credit for development increased. On a year-over-year basis, the stock of residential construction loans was down 2.4%, the first year-over-year decline since 2013.

Job Openings and Labor Turnover Survey (JOLTS): Tuesday, June 8

The job openings rate in construction increased to 4.4% in March, with 344,000 open positions in the sector. This is higher than the 228,000 count recorded a year ago. Hiring in the construction sector rose to a 6% rate in March. The peak rate of hiring in 2020 occurred in May (10.3%) as a rebound took hold in home building and remodeling. Meanwhile, the construction layoff rate ticked down to a 2% in March, consistent with the demand for more workers.

Consumer Price Index (CPI): Thursday, June 10
The Consumer Price Index – Urban Consumers (CPI) rose 0.8% in April on a seasonally adjusted basis, the largest increase since June 2009. The “core” CPI, which excludes the volatile food and energy components, increased 0.9% in March, the largest increase since April 1982. Over the past twelve months, on a not seasonally adjusted basis, the CPI grew 4.2% and the “core” CPI climbed 3.0% in April. Both headline inflation and core inflation jumped in April, reflecting strong consumer demand for products and services as the economy reopens from the COVID-19 recession.

Governor DeSantis Signs HB 337 "Impact Fees"

Friday evening, Governor Ron DeSantis officially signed into law FHBA priority legislation, House Bill 337, "Impact Fees." This legislation is a product of FHBA's Government Affairs Committee, which includes representation of all 23 local Building Industry Associations.

This law is highly anticipated, especially following the drastic impact fee increases that accelerated across the state in 2020.

Last year seemed to be a reckoning for our industry, as local governments looked to these fees the “golden goose” for increased lines of revenue.

A very special thank you to Senator Joe Gruters and Representative Nick DiCeglie for crafting and carrying this legislation across the finish line. Both are truly Housing Champions that deserve every ounce of credit- and our continued support too keep these two construction advocates in office. It is the Legislature’s hope that this new law will slow down impact fee increases, restore market predictability, eliminate frivolous expenditures and help curtail the rising costs of homeownership.

The new law will prohibit any increases greater than 12.5% annually. Although the law offers a relief valve to prevent moratoriums due to concurrency, the statute is designed to ensure this exception does not become the rule, and specifically provides strict provisions that cities and counties must meet. Perhaps the greatest news, is that the phase-in provisions of the 12.5% increase are retroactive to January 1, 2021.

For the first time, this law also includes a definition of infrastructure including a specific list of facility types that impact fees may be authorized for. The list does not include jails or general government buildings, and the definition of infrastructure ensures monies are spent on true capital expenditures, i.e., brick and mortar facilities, not uniforms, art, furniture, or fixtures. These definitions will ensure impact fee consultants, hired by local governments, cannot throw every expense conceivable into the pot when calculating future fee increases.

The bill also cleans up various impact fee statutes to ensure legislative intent is clear. For example, ensuring local governments attest that all impact fees are collected and expended correctly, ensuring any impact fee increases are not applied to pending permit applications, and that all impact fee credit holders (past and present) may transfer credits to adjoining impact fee zones.

The 2021 Legislative Session was like no other. However, with the aid of a robust FHB PAC, we can continue to elect pro-construction and pro-business candidates across the state. FHBA Asks Governor To Support HB 919

Last week, FHBA sent a letter to Governor DeSantis requesting his support of HB 919, relating to Preemption Over Restriction of Utility Services.

HB 919 addresses local governments such as the City of Tampa, which proposed a resolution banning natural gas hookups to new and existing homes. HB 919 will prohibit local governments from enacting rules that would restrict or otherwise prohibit the types of fuel sources of energy which may be used to serve customers.
